  7. GoLodger.com may use your posted units on social-media websites to advertise for you or for itself.

  8. GoLodger.com receives information from your computer, your Internet browser, and GoLodger.com cookies automatically. This information includes your IP address. We also collect and preserve data about the pages you visited on the website.

  9. The Website collects and preserves information when you visit the pages of business partners of GoLodger.com. The Website reserves the right to merge or collect information about you from the information received from Our business partners and/or other companies.

  10. Users are not allowed to use our website to collect data about other Users or to send them annoying messages. By doing so, you will be violating Our Terms and Conditions and Privacy Policy.

  11. Our servers are located in the United States. By choosing to provide us with personal information, you consent to the transfer of this data to our servers.

Terms and Conditions

GoLodger.com:

GoLodger.com is an electronic web-portal that includes social media plug-ins. GoLodger.com serves as an online platform through which users interact and communicate with each other and conclude agreements. GoLodger.com itself does not offer any accomodation; it merely provides an online system which acts as an intermediary between users to conclude agreements at their sole discretion. GoLodger.com is referred to later as the first party or the “platform” or “website” or “GoLodger” or “We”.

 

User:

The User is the registered member in the website’s database or a visitor, or both which have accessed the website at their own willingness. They are referred to later as the “Second Party” or the “User”. By accessing our website or using our services, you consent to the validity of these Terms and Conditions. GoLodger enables registered Users  who offer Accommodations (Users who offer Accommodations are “Hosts”) to publish their Property on the GoLodger Platform (“Listings” or “Accommodations” or “Unit”) and to communicate and transact directly with Users that are seeking to book such Accomodations (Users seeking to rent Accomodations are “Guests”).

 

Content:

“Content” means any material published on the website such listings, forums, event listings, reviews, postings, messages, text, files, images, photos or any other material; this is not an exclusive nor an exhaustive list.

 

The GoLodger Platform, GoLodger Content, and Member Content may in its entirety or in part be protected by copyright, trademark, and/or other laws of the countries the website operates in. The user acknowledges and agrees that the GoLodger Platform and GoLodger Content, including all associated intellectual property rights, are the exclusive property of GoLodger.com and/or its licensors or authorizing third-parties.

 

Service:

“Service” is all the services and particulars available to the user on the website upon his visit or registration or use of published content and will include any other new services that might become available to the user on the website. The website makes the service available to users, at its own discretion, for a fee or without fee.

 

Terms of Use :

By accessing the website and using it, you are accepting the Terms of Use, as indicated below, and agree to abide by them. These are the terms on which GoLodger.com allows you to access and use the Website. If you do not agree to these Terms of Use, then you are not permitted to use the Website. GoLodger.com reserves the right to deny access to any user who do not abide by the Terms of Use stated below.

 

Scope of Service, General terms

  1. By entering the website, the user accepts these terms and conditions and agrees to abide by them

  2. GoLodger.com is not obliged to make available any number or type of services to the second party. The first party is free to determine the type, timing and conditions of use of the various services it offers. This agreement outlines the terms and conditions whereby the second party is allowed to access and use the website and its services, whether as a visitor or a registered user. Therefore, please read these Terms of Use carefully before you start using the website.

  3. Leases are concluded exclusively between the user providing the accommodation (“Host”) and the user renting the accommodation (“Tenant”) or the (“Guest”). GoLodger.com itself is not a party to the leases or contracts concluded between the website’s users. The Hosts and the Tenants are themselves responsible for satisfying their own contractual obligations. In the event of default, this must be negotiated between the users. GoLodger.com saves and will transmit the contact data of both parties for this purpose.

  4. GoLodger does not examine the legality, accuracy or completeness of properties or content listed on the website; however, GoLodger.com is entitled to verify any information including personal, legal and tax information of the users and ask for the corresponding proofs. GoLodger.com reserves the right to deny access to users who refuse to provide such information when requested.  

  5. By using the website, the user confirms that he complies with public law regulations, particularly those for payment, factoring and tax law obligations, which may also include any obligations under sales tax law or indirect tax obligations. The Host will be solely responsible for his obligations and duties under the applicable tax laws. GoLodger is not obligated and will not intervene in anyway to make tax payments or to calculate the applicable taxes on or to perform any tax related activities on behalf of the Host or the Guest unless it decides to do so at its own discretion.

  6. Hosts can apply their own house rules, terms and conditions to the accommodation they are renting as long as it does not affect or conflict with the General Terms and Conditions of GoLodger.

  7. The User shall not allow another person or entity to use his User account. The User will achieve that by protecting his username and password. The User will be held accountable if any information is leaked through his account. In case this happens against his will or by error, the user has the responsibility to inform GoLodger.com immediately.

  8. GoLodger.com is entitled to terminate access to the Website for any User with or without giving any reasons and with or without prior notice. This will especially apply in cases where the information provided by the subscriber upon registration is misleading and/or incorrect, or when a User publishes content that is misleading, harms others, sexual or violent in nature, or conflicts with public morality. The second party does not have the right to repudiate the first party’s decision and/or compel the first party to retract its decision.

  9. GoLodger.com does not assume any responsibility for any of the content published on the website or sent through it or linked to it. The content can not be taken for granted and/or relied upon in any way. If a User uses the service for any illegal or unlawful purposes, the User will be held accountable for this unlawful use, without any liability to the first party.

  10. GoLodger.com will mediate when necessary between users, and has the final say in all disputes.

  11. The first party shall maintain the confidentiality of the data of the second party. Please review Our Privacy Policy.

  12. Some of the Services offered by the website are free and some are offered for a fee. GoLodger.com reserves the right to charge a fee for services currently offered for free in the future, as it sees fit, and the user will have the right to accept or reject such services.

  13. By posting a sponsored ad, you accept the website site’s “fair” methodology of allocating premium Ads, with the reservation that fair does not mean equal. We aim to Increase the probability of premium Ads views per average user. Increasing the probability does not mean appearing to all users, and the user has the right to refuse or accept this service.

  14. GoLodger.com is entitled to communicate with users to inform them of any news or additional services or suggestions or to transmit advertising material, as it deems appropriate, through written or audible or visible or interactive materials and/or instructions on its pages or via e-mail or via sms or through social-media websites (such as Facebook, Twitter, etc...), or as it sees fit. The broadcast of these materials will be evidence that the user is aware of them.

  15. The first party or one of its affiliates shall thereby provide the necessary technical support for Users abiding by the terms of this agreement.

  16. The Website does not guarantee the continuity of the service or that it will be provided without interruption, or that the service will be error-free or provided in a timely manner. The Website does not guarantee the desired or expected results from the use of its services, and will not be held liable to the user or any entity for any consequences of using or not using its services.

  17. The user is not entitled to use the trademarks and logos of GoLodger.com in any personal or commercial transactions without the permission of GoLodger.com.

  18. GoLodger.com will not be held liable for any transactions that occur via the website. The Website will not be responsible in the event of non-completion of a transaction or for the quality of the underlying property or for the nature of the transaction or for other factors that are related to the transaction or stems from it. The responsibility and the risk of using the Website lies with the User as the Website is provided without warranty and is provided on an “as is, as available” basis. Therefore, under these Terms of Use, GoLodger.com denies any liability or responsibility for, and without limitation, direct, indirect, special, punitive, incidental or consequential loss or damage incurred by any user in connection with the website or in connection with the use, inability to use, or results of the use of the Website, any websites linked to it and any materials posted on it. Caveat emptor principle applies.

  19. GoLodger.com reserves the right to amend the terms of this agreement without prior notice

  20. GoLodger does not endorse any Member, Listing or Host Services. Any references to a Member being "verified" (or similar language) only indicate that the Member has completed a relevant verification or identification process and nothing else. Any such description is not an endorsement, certification or guarantee by GoLodger about any Member, including of the Member's identity or background or whether the Member is trustworthy, safe or suitable. You should always exercise due diligence and care when deciding whether to stay in an Accommodation or use other Host Services, accept a booking request from a Guest, or communicate and interact with other Members, whether online or in person.

  21. Hosts and Tenants are responsible for their adherence to the provisions governed by public law, including municipal codes regarding property rental.

 

Account Registration, Contractual declarations

  1. When you register as a member by filling out the registration application, you agree to submit correct information and update it when necessary.

  2. The user can receive contractual declarations at his stated e-mail address.

 

User obligations, user account, system integrity

  1. The Host is responsible for ensuring that the accommodation he offers is described accurately, correctly and completely. He must provide the information in GoLodger’s required fields at a minimum so that the accommodation and the offer are described with sufficient accuracy.

  2. The Host is free to stipulate further conditions such as the amount of any deposit, the cost of final cleaning, cancellation options, etc... The various cancellation policies that can be agreed are available under cancellation policies.

  3. The user is liable to GoLodger for all actions performed using his user account, unless the user is not responsible for the misuse of his user account.

  4. Once the user is aware that third parties have access to his user data or have otherwise gained access to his user account, he must notify GoLodger of this immediately. GoLodger is entitled to then block the user account until the situation has been clarified.

  5. Brokers, agents and/or any other person(s) and/or representatives acting on behalf of the Property Owner(s)  must have the legal capacity / standing to do so. GoLodger is not responsible for verifying such legal capacity / standing. GoLodger will only proceed to remove the property from the platform and block the user account once notified by the Property Owner about any potential misuse or unauthorized use of the property. GoLodger will cooperate with the Property Owner on best effort basis and will provide him with all the available information; however, GoLodger will not be in anycase obliged to do so and will do so only at its sole discretion.

  6. Each user must independently verify the identity of his respective contract partner. GoLodger does not accept any liability for the accuracy of the user contact or personal information entered on the platform.

  7. The user undertakes to set up his systems and programmes in connection with the use of GoLodger offering in a way that ensures that the security, integrity and availability of systems set up by GoLodger to provide its services are not affected.

  8. Users must not use addresses, contact data, or e-mail addresses that they obtain by using the website for any purpose other than for contractual communication. In particular, these data must not be forwarded to unauthorised persons or used to send advertising, unless the user in question has expressly granted his consent in advance.

  9. The user absolutely must not send mass messages with the same content via GoLodger.com. Any spamming or similarly harassing action towards other users or third parties is prohibited and the user might be permanently banned as a consequence.

  10. Each user is himself responsible for archiving any information that is received when making a transaction for the purposes of preservation of evidence, accounting, taxes, etc. on a storage medium independent of GoLodger. GoLodger is not responsible for availing or for record keeping such information.

 

Handling of content and rights

  1. GoLodger saves for the user the multimedia content uploaded by him (images, text, etc...). It merely arranges the necessary memory space and access to it. Users themselves are therefore solely responsible for the content they upload to GoLodger and indemnify GoLodger against all third-party claims resulting from this. This indemnification also includes the costs incurred for the purposes of prosecution and legal defence and any other incidental costs that are incurred.

  2. You give GoLodger.com for free the non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to use, copy, reproduce, distribute, display, modify or create derivative works of the Content perpetually and for any purpose GoLodger.com sees appropriate. The User warrants that the holder of any rights, including moral rights in such Content, has completely and effectively waived all such rights and irrevocably gave the User the right to grant the license, or distribute or advertise or use or transmit such content.

  3. The content offered via GoLodger is protected by copyright. The platform is generally accessed and utilised individually by a natural person using a web browser. The use of technologies such as web spiders, crawlers, or similar programmes, the purpose of which is not just the indexing of content but also the mass accessing and saving of the platform’s content is prohibited. This also applies in particular to technologies that enable so-called screen scraping and other third-party services.

  4. The website offers online electronic and interactive services, and the second party uses it at their own will. GoLodger is generally accessed and utilised individually by a natural person using a web browser, a mobile device, a tablet, or any other similar devices. The use of technologies such as web spiders, crawlers, or similar programmes, for purposes other than just indexing the website’s content is prohibited. The mass accessing and saving of the GoLodger’s content is strictly not allowed. This also applies to technologies such as screen scraping.

  5. User agrees that the Website and the company that manages it (or its subsidiaries or affiliates, as appropriate) are the owners or the entity authorized to use all intellectual property rights of content posted on this website, and that the Website itself is a collective work and/or compilation solely owned by GoLodger.com. The Website enjoys protection of copyright laws and treaties around the world. You may not copy, distribute, reproduce, sell, lease, assign, rent, sublicense, encumber any aspect of the Website or any of its Content.

  6. Users and visitors are not allowed dismantle or partake in any analysis of source code contained in the Website or any software or database associated with the Website. Users and visitors are also not allowed to reverse engineer the code or try to discover it in another way.

 

Dispute Resolution

  1. GoLodger may mediate to resolve disputes between Users only at its only discretion; however, GoLodger is not obliged to do so.

  2. While GoLodger may help facilitate the resolution of disputes, GoLodger has no control over and does not guarantee:

    1. the existence, quality, safety, suitability, or legality of any Listings or Host Services

    2. the truth or accuracy of any Listing descriptions, Ratings, Reviews, or other Member Content,

    3. the performance or conduct of any Member or third party.

    4. the compliance of any Member or third party to GoLodger’s proposed resolution to any given dispute.

  3. GoLodger has the final say in all disputes and reserves the right to terminate the membership of any member who does not abide by the proposed resolution for any given dispute.

 

Availability and amendment of the website

  1. The service is available to all people from all parts of the world without any discrimination on the basis of nationality, gender, religion or race.

  2. The user has no legal claim to permanent use of the platform. In particular, GoLodger is not required to ensure that the platform is available or can be reached at all times. However, GoLodger endeavours to maintain operation of the platform with as few disruptions as possible and to continue to develop it in line with user requirements.

  3. GoLodger can temporarily restrict use if this is necessary in terms of security, integrity, capacity limits, or the performance of technical measures (maintenance work).

 

Liability for third-party sites

  1. The platform’s pages also include links to websites on the Internet maintained by third parties, the content of which is not known to GoLodger. GoLodger merely provides access to the websites and accepts no responsibility for the content. The links to third-party Internet sites merely serve to facilitate navigation. GoLodger does not endorse the views expressed on the sites to which it links, and rather hereby expressly distances itself from all content on all websites that it links to on its platform.

  2. GoLodger is not responsible for third-party offerings or content. The owners of third party content or Internet sites to which GoLodger.com links to are solely responsible for both their content and for the goods or services that they offer.

  3. By posting your listing on GoLodger.com, you also agree that your property’s data will be shared and viewed on third party websites and/or applications with which GoLodger has an agreement with. In any case, GoLodger is not responsible for any booking made via a third party website and/or application and these bookings will be concluded solely at the Host’s discretion. The Host will be notified that this is a booking from a third party.

 

Booking process, payment, invoicing

  1. By listing an accommodation on GoLodger.com, the Host is issuing an invitation to submit offers. Another user can submit an offer to conclude a lease for this accommodation. The agreement arises if the Host accepts this offer within 24 hours in a manner intended by GoLodger. Otherwise, the other user is no longer bound to his offer.

  2. You understand that a confirmed booking of an Accommodation (“Booking”) is a limited license granted to you by the Host to enter, occupy and use the Accommodation for the duration of your stay, during which time the Host (only where and to the extent permitted by applicable law) retains the right to re-enter the Accommodation, in accordance with your agreement with the Host.

  3. You agree to leave the Accommodation no later than the checkout time that the Host specifies in the Listing or such other time as mutually agreed upon between you and the Host. If the checkout time is not specified by Host, the checkout time will be 10:00 AM by default. If you stay past the agreed upon checkout time without the Host's consent (“Overstay”), you no longer have a license to stay in the Accommodation and the Host is entitled to make you leave in a manner consistent with applicable law. In addition, you agree to pay, if requested by the Host, for each twenty-four (24) hour period (or any portion thereof) that you Overstay, an additional nightly fee of up to two (2) times the average nightly Listing Fee originally paid by you to cover the inconvenience suffered by the Host, plus all applicable Guest Fees, Taxes, and any legal expenses incurred by the Host to make you leave (collectively, "Overstay Fees"). Overstay Fees for late checkouts on the checkout date that do not impact upcoming bookings may be limited to the additional costs incurred by the Host as a result of such Overstay. GoLodger Payments will collect Overstay Fees from you pursuant to the Payments Terms. A Security Deposit, if required by a Host, may be applied to any Overstay Fees due for a Guest’s Overstay.

  4. Cancellations are considered to be withdrawals before the planned check-in. One of the options shown under Cancellation Policies can be agreed. Refunds required as a result will be paid by GoLodger to the Guest after deducting any applicable cancellation fees and any cost incurred in making the refunds. 

  5. The Host must ensure that:

    1. the description of the accommodation and the images used do not violate the law or third-party rights and that they relate only to the accommodation on offer.

    2. successfully booked accommodation is indicated accordingly.

    3. information uploaded does not constitute references to third-party content.

    4. he complies with public law regulations, particularly those for payment, factoring and tax law obligations, which may also include any obligations under sales tax law or indirect tax obligations. The Host will be solely responsible of the obligations and duties of the offer content. GoLodger is entitled to verify whether Hosts are fulfilling their tax obligations or not. 

  6. The payment process shall take place under the following provisions:

    1. The agreement arises by way of a total price shown at the end of the booking. This consists of the rent, the service fee and any other fees demanded by the Host such as cleaning fees. The fees comprise of an administration component and a property-based component.. After a booking has been made, GoLodger notifies users of its content and the total price.

    2. GoLodger is entitled to change the amount of service fees at any time. This does not apply to leases already concluded.

    3. The Tenant must pay the total price shown in the booking by way of the channel chosen in the booking process. GoLodger receives the money from the Tenant on behalf of the Host and holds it for the Host. The booking is only considered concluded once GoLodger receives the rent amount from the Tenant. This especially applies to payments via Cash Collection and Bank Deposit.

    4. GoLodger transfers the rent amount to the Host 24 hours after Guest check-in in the rented accommodation if the Guest did not raise any dispute or submit any request to GoLodger to hold or cancel the payment. In case the Guest wants to raise a dispute or hold the payment, instructions to GoLodger must be sent immediately using the contact form in the Contact Us page stating grounds and/or rationale for doing so.

    5. If use of the accommodation is not transferred to the Tenant as per contractual arrangement, the Tenant has the right to a full refund.

    6. The Host shall satisfy his obligation to pay the service fee to GoLodger by way of GoLodger deducting the service fee from the rent amount and transferring the balance amount to his account, so that the Host does not have to make any further payments.

    7. Users can offset GoLodger service fees against receivables only if these are due and have been legally established or are undisputed. Receivables cannot be transferred to third parties.

  7. On request, the Host must issue the Tenant with an invoice for the total price. On request, GoLodger will issue the Host with an invoice for the service fee, though this will be shown without sales tax or similar indirect taxes in accordance with tax law provisions, unless expressly stated otherwise in these regulations.

  8. Unless GoLodger is notified otherwise, it is refutably assumed that the Host operates in a business capacity and is aware of his resulting (sales) tax obligations and satisfies these accordingly. GoLodger is entitled to demand corresponding evidence of the Host’s business capacity.

  9. The Host reserves the right to additionally charge other on-site costs based on consumption and use (in particular: electricity, water, heating). The Host must advise the Tenant that he has a basic right to charge these costs before concluding the agreement. Such costs are not taken into account in the calculation of the service fee. This also applies to any security deposit.

  10. Booking vouchers issued by GoLodger can be used by Tenants to make bookings within set periods. Tenants do not receive any payment.

  11. Users are prohibited from circumventing the above booking and payment processes, in particular the service fees.

 

Security Deposit

  1. The Host is entitled to charge a security deposit in his offer. If a Host demands a security deposit from the Tenant on the day of arrival, corresponding information on the amount of the security deposit and the payment method must have already been mentioned in the offer and/or the property description. The amount of the security deposit must be stipulated prior to the booking. It must also be clarified in advance when the amount must be paid (e.g. three months before arrival, in cash on arrival).

  2. If the Host did not mention the security deposit when advertising his accommodation, but demands a security deposit at a later time and the Tenant does not agree, this constitutes a refusal to render performance by the Host under the agreed contract. In such cases, GoLodger reserves the right to cancel the booking and to charge the Host a cancellation fee.

  3. GoLodger is not responsible for the administration of security deposits or for any claims asserted by the Host.

 

Review system

  1. The website allows users to review each other after the conclusion of the transaction. Reviews are intended to provide meaningful information on users' trustworthiness. The reviews are not reviewed in advance by GoLodger.

  2. Users undertake to make only truthful statements in the reviews they submit and to comply with the corresponding legal provisions. The reviews expressed by users must not violate third-party rights, in particular personality rights. They must be objective and must not contain defamatory criticism.

  3. Any use of the review system contrary to the purpose of the review system is prohibited. In particular, users are prohibited from issuing reviews about themselves or arranging for third parties to let information be known in reviews that is unrelated to the settlement of the underlying agreement, and are prohibited from using reviews for any purpose other than presentation on the website.

  4. GoLodger does not intervene in the review system without justifiable grounds. Reviews issued will be neither amended nor removed by GoLodger unless GoLodger is legally and specifically required to do so. Reviews cannot be altered after they have been posted. They are saved permanently in a user’s reviews profile and can be viewed by all users. GoLodger is entitled to add notes to a review if this is useful for clarification and a better understanding of the review in question. The only case where GoLodger will publish a review in place of a user is if the Host has cancelled a booking, in which case an automatic one-star review will be published on the offer.

  5. If reviews are abused by a user, GoLodger shall have the right to remove the review as an exception and to take the measures stated in section 12. This applies in particular if:

    1. the review must be removed on account of an enforceable court ruling against those who issued the review;

    2. the comment contains remarks that are vulgar, obscene, racist, not suitable for minors, sexual in nature or criminally offensive;

    3. the review contains another member’s personal information, such as name, address, telephone number or e-mail address;

    4. the review contains unauthorised links or scripts;

    5. if a user has inadvertently posted a negative review for the wrong user, but has already corrected this error and assigned the same review to the correct user;

    6. the review was issued by a person who was not authorised to make the booking;

    7. the review comes from a user whose user account was blocked by GoLodger within 90 days of registration. This does not apply to user accounts that are blocked for non-payment of a service fee or in situations where users are granted the opportunity to solve the problem and the user account is restored.

  6. If both users agree, a review that has already been issued can be withdrawn. The review point will be removed and will no longer be included in the reviews profile.

 

Duration, termination

  1. This Agreement shall be effective for an indefinite amount of time until such time when you or GoLodger terminate the Agreement in accordance with this provision.

  2. You may terminate this Agreement at any time via the "Delete Account" feature in the User Account on the GoLodger platform. If you cancel your GoLodger Account as a Host, any confirmed booking(s) will be automatically cancelled and your Guests will receive a full refund. If you cancel your GoLodger Account as a Guest, any confirmed booking(s) will be automatically cancelled and any refund will depend upon the terms of the Listing’s cancellation policy.

  3. Without limiting our rights specified below, GoLodger may terminate this Agreement with or without prior notice

  4. GoLodger may immediately, without notice terminate this Agreement if (i) you have materially breached your obligations under these Terms, the Payments Terms, our Policies or Standards, (ii) you have violated applicable laws, regulations or third party rights, or (iii) GoLodger believes in good faith that such action is reasonably necessary to protect the personal safety or property of GoLodger, its Members, or third parties (for example in the case of fraudulent behavior of a Member).

  5. In addition, GoLodger may take any of the following measures (i) to comply with applicable law, or the order or request of a court, law enforcement or other administrative agency or governmental body, or if (ii) you have breached these Terms, the Payments Terms, our Policies or Standards, applicable laws, regulations, or third party rights, (iii) you have provided inaccurate, fraudulent, outdated or incomplete information during the GoLodger Account registration, Listing process or thereafter, (iv) you and/or your Listings or Host Services at any time fail to meet any applicable quality or eligibility criteria, (v) you have repeatedly received poor Ratings or Reviews or GoLodger otherwise becomes aware of or has received complaints about your performance or conduct, (vi) you have repeatedly cancelled confirmed bookings or failed to respond to booking requests without a valid reason, or (vii) GoLodger believes in good faith that such action is reasonably necessary to protect the personal safety or property of GoLodger, its Members, or third parties, or to prevent fraud or other illegal activity:

    1. refuse to surface, delete or delay any Listings, Ratings, Reviews, or other Member Content;

    2. cancel any pending or confirmed bookings;

    3. limit your access to or use of the GoLodger Platform;

    4. temporarily or permanently revoke any special status associated with your GoLodger Account; or

    5. temporarily or in case of severe or repeated offenses permanently suspend your GoLodger Account.

  6. In case of non-material breaches and where appropriate, you will be given notice of any intended measure by GoLodger and an opportunity to resolve the issue to GoLodger's reasonable satisfaction.

  7. If we take any of the measures described above (i) we may refund your Guests in full for any and all confirmed bookings that have been cancelled, irrespective of preexisting cancellation policies, and (ii) you will not be entitled to any compensation for pending or confirmed bookings that were cancelled.

  8. When this Agreement has been terminated, you are not entitled to a restoration of your GoLodger Account or any of your Member Content. If your access to or use of the GoLodger Platform has been limited or your GoLodger Account has been suspended or this Agreement has been terminated by us, you may not register a new GoLodger Account or access and use the GoLodger Platform through an GoLodger Account of another Member.

  9. If you or we terminate this Agreement, the clauses of these Terms that reasonably should survive termination of the Agreement will remain in effect.

 

Measures in the event of illegal conduct and/or conduct in breach of contract by the user

  1. GoLodger.com is entitled to terminate access to the Website for any User with or without giving any reasons and with or without prior notice. This will especially apply in cases where the User is violating legal provisions, third party rights or when the information provided by the subscriber upon registration is misleading and/or incorrect, or when a User publishes content that is misleading, harms others, sexual or violent in nature, or conflicts with public morality. The second party does not have the right to repudiate the first party’s decision and/or compel the first party to retract its decision.

  2. In case GoLodger determines that a user is in breach of its Terms & Conditions and/or is not acting in good faith, GoLodger can contest and cancel existing leases in the name of the Host without taking into account the otherwise applicable cancellation policies, and reject the user’s offers for the conclusion of a lease in the name of the Host.

  3. Leases that have already been concluded between the user and other users are not affected by deletion of a property. This applies accordingly to claims for the payment of service fees already due. An effective lease does not arise if GoLodger deletes an offer before it is accepted by a user.

  4. GoLodger reserves the right to block a user, taking the legitimate interests of the users into account, if the user has repeatedly received negative reviews.

 

GoLodger’s Liabiltiy

  1. As GoLodger does not participate in the contractual relationship between the Tenant and the Host, GoLodger accepts no liability for contracts for accommodation.

  2. GoLodger is not liable for refunding the Guest or the Host their service fees in situations where GoLodger is not at fault or when GoLodger is acting within it's terms, conditions and policies. 

 

Closing provisions

  1. GoLodger is authorised to transfer its rights and obligations under this agreement in full or in part to third parties.

  2. GoLodger is authorised to transfer its rights and obligations under this agreement in full or in part to third parties.

  3. If individual provisions of these General Terms and Conditions are or become wholly or partially invalid, the other General Terms and Conditions are still valid. In the event of such a provision being invalid, it shall be replaced by a legal provision.

  4. All declarations to be sent in connection with the user agreement to be concluded with GoLodger must be issued by email. The contact form and contact information can be found in the Contact Us page. It is the User’s responsibility to make sure that GoLodger has received his communication.

  5. The Courts of the United States of America will be responsible for resolving any disputes that may arise, God forbid, due to the implementation of this contract.

Cancellation Policy

Free cancellation:

  • Cancellation is free of charge anytime before check-in 

  • GoLodger.com Service Fees are non-refundable in all cases.

Flexible (10%):

  • Cancellation fee of 10% of total rent amount if Guest cancels anytime before check in

  • The cancellation fees exclude GoLodger.com's service fee. GoLodger.com's service fee is non-refundable in all cases.

  • A reservation is officially confirmed once GoLodger.com collects the deposit amount from the Tenant. Please check the payment policy below.

  • A reservation is officially canceled when the Guest clicks the cancellation button on the cancellation confirmation prompt or when the Guest notifies GoLodger.com.

 

Strict (20%):

  • Cancellation fee of 20% of total rent amount if Guest cancels anytime before check in.

  • The cancellation fee excludes GoLodger.com's service fee. GoLodger.com's service fee is non-refundable in all cases.

  • A reservation is officially confirmed once GoLodger.com collects the deposit amount from the Tenant. Please check the payment policy below.

  • A reservation is officially canceled when the Guest clicks the cancellation button on the cancellation confirmation prompt or when the Guest notifies GoLodger.com.

 

Very Strict (50%):

  • Cancellation fee of 50% of total rent amount if Guest cancels anytime before check in.

  • The cancellation fee excludes GoLodger.com's service fee. GoLodger.com's service fee is non-refundable in all cases.

  • A reservation is officially confirmed once GoLodger.com collects the full reservation amount from the Tenant. Please check the payment policy below.

  • A reservation is officially canceled when the Guest clicks the cancellation button on the cancellation confirmation prompt or when the Guest notifies GoLodger.com.

 

Non-refundable (100%):

  • The full rent amount and GoLodger’s service fees are non-refundable if the Guest cancels at any time

  • A reservation is officially confirmed once GoLodger.com collects the full reservation amount from the Tenant. Please check the payment policy below.

  • A reservation is officially canceled when the Guest clicks the cancellation button on the cancellation confirmation prompt or when the Guest notifies GoLodger.com.

 

Cancellation by the Host:

  • GoLodger.com takes booking cancellation very seriously as it gives a negative experience to Guests.

  • In the case of a cancellation by the Host, the Guest will be reimbursed the full price of the booking. In such cases, no cancellation fees will be incurred by the Guest.

  • GoLodger will help the Guest find alternative accommodation to the best of its abilities.

  • GoLodger will publish an automatic one-star review on the Host’s property.

  • The Host must pay a cancellation penalty fee of 20% from his next booking.

  • The cancellation penalty will be deducted from the Host’s outstanding amounts with GoLodger.com. If there is no outstanding amount or if there is any remaining amount, it will be deducted from the Host’s next booking(s) or it can be paid voluntarily by the Host to GoLodger.com.

  • The Host will not receive a payment from any bookings they have canceled.

  • The listing connected to the canceled booking will be penalized in the rankings; this could lead to less booking requests in the future. Furthermore, the dates won’t be available for anyone else to book.

  • For the second time the Host cancels a booking, the Host will pay a penalty fee of 50% from his next booking with GoLodger.com. Any subsequent cancellations after that may lead to the permanent removal of the Host’s property from GoLodger.com and the Host will not be able to post any units on GoLodger.com.

  • GoLodger, at its own discretion, has the right to waive the the penalty fees and the one-start review if the cancellation was done for Extenuating Circumstances, such as an unexpected death of a family member or a serious illness.

Payment Terms

  • After the Host has confirmed the booking, GoLodger.com collects the deposit amount from the Guest via his chosen payment method.

  • The booking is considered to be confirmed only when GoLodger.com collects the deposit amount from the Guest.

  • The Guest pays the remainder of the rent amount at Checkin. 

  • GoLodger.com releases the deposit amount minus our Service Fees and any banking / transactional charges to the Host 24 hours after Guest check-in. If check-in happens on a weekend or on a public holiday, the Host will receive the funds the first working day after that. The time it takes for the Host to receive the funds depends on the Host's chosen preferred payout method.

  • The Host is responsible for updating his preferred Payout Method in the user profile so that GoLodger.com can send the amounts received for property rentals.

  • Currently the only Payout Method available is wire transfers to the Host's bank account. The user can update his bank account information securely in the Payout Method tab in the User Profile.

  • In case of any refunds to the Hosts or to the Guests, it will be done using the transfer method which is most convenient for GoLodger.com.

Cash Bookings

  • Cash on Delivery and Cash Deposit collectively known as "Cash Bookings" are services which are only provided in Egypt
  • The difference between a Cash Bookings and Credit Card booking is that in the Cash Booking scenario, the Host pre-approves a booking by giving the Guest a grace period of 48 hours post his pre-approval to pay the deposit amount.
  • Unlike Credit Card bookings, the Cash Bookings are not instantly confirmed until the Guest pays the deposit amount within the 48 hour time frame.
  • As a consequence, if the Guest did not pay the deposit amount within the 48 hour grace period, the booking will automatically expire and the Host's unit will be free during that period. 
  • By pre-approving a Cash Booking, the Host accepts that the booking can expire without payment by the Guest and that no penalty charges will be applicable. The penalty charges become applicable only when the deposit amount is collected from the Guest. 
  • By pre-approving a Cash Booking, the Host also agrees not to accept any other bookings for the period during which the Cash Guest has requested to book and the Host shall give the Guest the the agreed 48 hour grace period to make the payment.
  • As a Host, it is important to know that once you pre-approve a Cash Booking, GoLodger notifies a third party company to coordinate with the Guest for the Cash Collection. This is a time investment from us, the third party company and the Guest. Therefore, you should commit your property to the Guest and accept the non-collection risk that comes with Cash Bookings. If this is not suitable for you, then you should reject all Cash Bookings and accept only Credit Card Bookings as they are instantly confirmed (i.e once a booking request is submitted, and you approve, the deposit amount is deducted from the Guest's credit card and there is no risk of non-collection).
  • Cash Bookings account for the majority of the bookings, therefore we advise using them. 

Host Liability and Applicable Penalties

  • The Host may be liable for a penalty of 20% in the case of posting inaccurate data on the website and / or in the case of handing over the unit in poor conditions to the Guest (unless otherwise displayed / described clearly on the unit’s page or pre-agreed with the Guest)

  • Guests must report any issues / inaccurate data within 12 hours of check-in. Failure to report any issues within the first 12 hours means that the Guest has accepted the condition of the property as is.  

  • In case GoLodger receives a complaint by the Guest that the property data listed on the website is inaccurate, GoLodger will hold the Host’s payment and will launch an investigation to compare facts during which it may ask the Guest to submit photos and / or videos that may support their claim.

  • In case the data is found to be inaccurate, the Host must refund 20% of the rental amount to the Guest if the Host and the Guest mutually agree to continue the lease.

  • In some cases, when the data is extremely inaccurate, the Guest might get a refund of 50% if he decided to continue his stay at the property. GoLodger has the sole discretion over deciding on the refund amount and its decision will be final.

  • In case the Guest decides to vacate the property, he will be entitled to a full refund.

  • GoLodger has the final say in all disputes and its decision is considered final. Not agreeing to GoLodger’s decision can be considered a breach of contract and can result in terminating the User’s account.

  • The Host must amend the property’s data and ensure that the information on the website is complete and accurate in order to comply with GoLodger’s Terms and Conditions. Failure to do so will lead to the permanent removal of the property from the website and to the disabling of the Host’s account.  

  • The Host’s property will be permanently removed and his account will be permanently deactivated if GoLodger receives a second complaint about data inaccuracy.

 

Guest Liability:

  • The Guest must abide by the terms & conditions of the platform.
  • In case of no show, the deposit amount along with GoLodger's service fees are non-refundable. 
  • In case of cancellation by Guest, the deposit amount along with GoLodger's service fees are non-refundable. 
  • The deposit amount paid along with GoLodger service fees are non-refundable in cases where the Guest is not abiding by GoLodger's terms & conditions and the Host House rules. 
  • GoLodger is only responsible for the information provided on the website. In case the Guest books based on information which is obtained from outside sources, GoLodger will not be responsible for refunding the Guest. 
  • Each unit has a maximum number of people it can accommodate which is displayed on the website. In case the Guest books a unit through GoLodger and the number of people in his party is greater than the number of people displayed on the website, the Host has the right to deny the Guest entry to the unit and any amounts paid by the Guest will be non-refundable. That includes the deposit amount and GoLodger service fees. 
  • In cases where the Host agrees to refund the Guest the deposit amount, GoLodger reserves the right to retain its service fees in case the Guest did not abide by GoLodger's terms, conditions and policies, the maximum number of people that can be accommodated in the unit which is displayed on the website, and the House rules. 
  • All fees not related to the property itself, such as resort passes, beach passes, etc.. is to be born by the Guest even if it is not mentioned on the property's description. 
  • Any extra fees related to the property such as cleaning fees, water and elecricity, etc... are to be born by the Guest if mentioned in the property's description 
  • At the Host's request, the Guest must pay a security deposit at checkin which is refundable at checkout provided that no damages happen to the property even if it is not mentioned in the property's description. All Hosts have the right to demand a security deposit as per GoLodger's policy. 

 

AXA Insurance Coverage:

Steps to Enroll in AXA Insurance Program:

  • The owner must contact GoLodger customer service in order to start the process of enrolling in the program by verifying the unit
  • The owner must present the ownership documenation proving that he owns the unit. 
  • Once the GoLodger team reviews the ownership documentation, they will send an email confirmaiton to the owner that his unit in verified and that he is enrolled in the AXA Insurance program. The owner will also receive a Code for his unit to be used for any Insurance claims.  

Notes:

  • Any unit which is not verified is not enrolled in the AXA insurance program 
  • The units can not be verified retroactively
  • The owner can not make any claims if he is not enrolled in the program and does not have a code. 

Steps to make an insurance claim:

  • Take a picture or a video of the damage caused by the guest
  • Send it to GoLodger team 
  • GoLodger team will confirm the damage with the Guest 
  • Once confirmed, GoLodger will Link the owner with AXA to process the insurance claim

Notes:

  • The security deposit is mandatory and will be deducted from the claim amount (min EGP 2,000) 
  • AXA charges an EGP 5,000 deductible for any claim
